Dozens of Australian companies undergo insolvency proceedings every year. If you’re drawing a wage from them when it happens, you might suddenly find yourself not only without a job but without your backpay or entitlements! What can you do?
Good news: there are safety nets in place!
The Australian Government provides a financial assistance to cover specific unpaid employee entitlements up to a set limit, within certain time frames.
If your employer went into liquidation or went bankrupt after 5th December 2012, you may be able to make a claim through the Fair Entitlements Guarantee (FEG). Generally, you must apply within 12 months of the date of job loss or liquidation.
For employer liquidation prior to 5th December 2012, you may be able to make a claim for any unpaid employee entitlements through the General Employee Entitlements and Redundancy Scheme (GEERS).
